Jury returned a not guilty verdict in a Class A Misdemeanor DWI (2nd) trial. Client faced a minimum of 3 days in jail, even if granted probation. Focus of the trial was the officer’s poor administration of the standardized field sobriety tests versus client’s reasonable performance. With new courtrooms and courtroom technology, we were able to use video screen demonstratives to compare how the National Highway Traffic Safety Administration (NHTSA) requires these tests to be administered, and how they were administered in this particular case. Jury explained afterward that they found this to be quite helpful.
